1. All bookings are non-refundable.

2. Maydena Bike Park reserves the right to temporarily close the park due to unforeseen circumstances, such as bushfires or significant weather events, which may pose a serious threat. The park will not generally close for wet weather. In the event of a park closure, all affected parties with prior bookings shall be notified via email and/or text message, with as much advance notice as possible. Customers impacted by the closure shall be eligible for a full refund, a credit voucher, or the option to transfer their booking to an alternative day or days.

3. Any cancellations, name and/or date changes for bookings must be requested by email to bookings@maydenabikepark.com or by calling 1300 399 664.

FLEXI ADD-ON BOOKINGS

4. If a customer has purchased a Flexi Add-On and requests a cancellation or amendment to their booking:

a. The Flexi Add-On grants the holder of the booking the right to the following without incurring any additional charges:

i. Modify the start date or the name associated with the booking

ii. Cancel the booking in exchange for a one-time credit voucher, valid for 3 years from the date of issue for the full amount of the booking less the $20 value of the Flexi Add-On.

b. All amendments listed in section 4.a. must be requested no later than 4 pm, 2 days prior to the commencement of the booking. For example, if the booking is scheduled for 9 am on Saturday, changes must be made by 4 pm on the preceding Wednesday.

c. Amendments are limited to Passes, Lessons, or Hire services of equal or lesser value within the same bike park season. If the rescheduled date carries a higher price value, the price difference shall be charged accordingly.

d. Customers are permitted to make a maximum of 2 changes to the same booking without incurring any fees. Subsequent changes to the same booking shall be subject to the same terms & conditions as outlined in Booking Changes subsection 5. (standard bookings) below.

e. The Flexi Add-On must be purchased once per order and at the time of booking; purchases made after the initial booking will not be valid.

STANDARD BOOKINGS

5. If a customer has NOT purchased a Flexi Add-On and requests a cancellation or amendment to their booking:

a. A customer has the right to the following for a fee of $25 upon each request.

i. Modify the start date or the name associated with the booking

ii. Cancel the booking in exchange for a one-time credit voucher, valid for 3 years from the date of issue for the full amount of the booking.

b. All amendments listed in section 5.a. must be requested no later than 4 pm, 5 days prior to the commencement of the booking. For example, if the booking is scheduled for 9 am on Saturday, cancellations must be made by 4 pm on the preceding Sunday.

c. Amendments are limited to Passes, Lessons, or Hire services of equal or lesser value within the same bike park season. If the rescheduled date carries a higher price value, the price difference shall be charged accordingly.

WALK IN BOOKINGS

6. Walk-in bookings made on the day will be subject to a fee of $5.

CREDIT VOUCHERS

7. Where credit vouchers are issued, hereinafter referred to as "Vouchers", the following terms and conditions govern the redemption and utilization of said Vouchers:

a. Redemption Eligibility: Vouchers shall be deemed redeemable for products offered through the online bookings system or alternatively, at guest services, and may further extend to encompass retail products.

b. Online Bookings System: The Vouchers may be utilized for the purchase of products accessible via the online bookings system, subject to any applicable terms and conditions related to the specific product.

c. Guest Services: In addition to the online bookings system, Vouchers may also be redeemed for products at guest services.

d. Once a voucher has been issued the guest's previous booking is considered to be cancelled and the new booking will be subject to all terms and conditions listed in this document.

UPLIFT

All customers of the Maydena Bike Park uplift service and related services agree to abide by the Park’s rider responsibility code at all times. Non-compliance with any of the park rules or regulations will render the users pass invalid. Significant breaches of the code may result in bans from the park.

All customers of the Maydena Bike Park uplift service and related services agree to the waiver as noted below. This waiver must be signed prior to arrival or upon arrival at the park via the link below. Any refusal to sign the waiver at the time of check-in will result in the cancellation of the booking without refund.

Bike hire customers are responsible for any damage caused to the bike during hire (excluding obvious equipment fault). Customers will be charged for any damage upon the return of the bike. Customers may reduce their damage liability to $0.00 by purchasing the optional damage waiver.

All hire bikes are for use with the park boundary and trails only. Use outside of the park may be granted with prior approval from the Maydena Bike Park Office.

COACHING AND TOURS

All bike school customers agree to abide by the Park’s rider responsibility code at all times. Non-compliance with any of the park rules or regulations will render the hire and the users pass invalid. Significant breaches of the code may result in bans from the park.

RIDER RESPONSIBILITY CODE

Stay in control- you are responsible for avoiding objects and people.
Know your limits- Ride within your ability. Start small and work your way up.
Protect yourself- Use appropriate bike and protective equipment
Respect and maintain your equipment
Be uplift smart- know how to ride, load and unload
Inspect trail and features- conditions change regularly
Obey signs and warnings- stay on marked trails only. Keep off closed trails. Ride only in the right direction.
Be visible- do not stop in unsafe areas/Look out for others/Cooperate- notify park management of incidents etc.
Obey the directions of park staff at all times

Lack of compliance with any of the above conditions may lead to cancellation of your uplift pass without refund.

AGE RESTRICTIONS
Bike park users under 18 years of age must be accompanied by a paying parent or guardian, who must remain with the minor for the duration of their riding in the park. The uplift service is only open to users 7 year of age or older.


GENERAL BIKE PARK WAIVER
GENERAL TERMS AND CONDITIONS, RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND ASSUMPTIONS OF RISKS

THIS IS A LEGAL DOCUMENT - READ CAREFULLY!

Mountain biking poses inherent risks, which may result in serious injury or death.

Maydena bike park is a gravity-based bike park-trails and trail features may be more challenging than those encountered on typical mountain bike trails.

By signing this agreement you will waive or give up certain legal right, including the right to sue or claim compensation following an accident - PLEASE READ CAREFULLY!

In this Release Agreement the term 'mountain biking' includes use of all Maydena Bike Park trails and related facilities, equipment hire, uplift services, guided rides and coaching sessions.

GENERAL TERMS AND CONDITIONS
GENERAL

1. Mountain biking is an inherently dangerous activity. In the Maydena Bike Park you will be exposed to risks including but not limited to; steep trails, avoidable and unavoidable obstacles, trail verge dangers, and changing trail and weather conditions. Even with all possible risk controls and protective equipment, the risk of severe injury or death remains.
2. Riders are responsible for ensuring that they have the physical capacity to complete the activity.
3. Riders MUST NOT utilise any trails or related infrastructure in the park while under the influence of drugs or alcohol.
4. All users of the park who are under 18 years of age, MUST have this form signed by a parent or guardian, who MUST remain with them at all times in the Maydena Bike Park.
5. Australian standards approved helmets MUST be worn in the park at all times.
6. Closed toe footwear and upper and lower body clothing MUST be worn at all times.
7. Maydena Bike Park STRONGLY RECOMMEND the use of a full face helmet and additional protective equipment, which may include but is not limited to; knee and elbow protection, chest and back protection, gloves, eyewear and neck braces.
8. Riders MUST NOT attempt any trail or trail feature unless they have the ability to do so. All trails and features MUST be ridden slowly to allow inspection of trail conditions prior to increasing rider speed. All riders MUST ride in control and within their ability at all times.
9. The Maydena Bike Park is a private bike park facility, and operates only within set operating hours. Use outside of these operating hours is strictly prohibited.
10. All users of the park are responsible for their own equipment and must ensure that their equipment is in good operating condition.
11. All park users MUST obey all trail closures, at all times.
12. To reduce the risk of spreading noxious weeds and plant-born diseases, all bikes MUST be washed clean before entry and exit to the park.
13. Minimum bike standards apply for trail and park users, all bikes must have two working disc brakes, and have front suspension as a minimum. 20” or smaller bikes are exempt from these requirements, though must meet minimum acceptable standards.
14. Maydena Bike Park reserves the right to revoke passes and/or refuse entry to any park user, for any reason.

COVID-19

1. In signing this agreement, park users declare that they do not have COVID-19, have not been in contact with any person who has COVID-19, and/or are not awaiting results from a COVID-19 test
2. All park users agree to comply with all government and park COVID policies and procedures.

HIRE AND RENTAL

1. All users hiring bikes and related equipment accept responsibility for the equipment, and agree to return equipment in the condition it was hired.
2. In the event of any damage, loss and/or destruction of equipment, the hirer will be liable for all costs of repair and/or replacement.
3. If taking out a damage waiver, this waiver will cover fair wear and tear and accidental damage. Damage through misuse of any kind will void the damage waiver.

RELEASE OF LIABILITY

I agree to waive any and all claims, and release Maydena Adventure Pty Ltd (trading as Maydena Bike Park) and their respective affiliates, subsidiaries, employees, contractors and representatives (herein after ‘the releasees’), relevant land managers and mortgagees from any and all liability from loss, damage, expense or injury, including death that I may suffer as a result of mountain biking (or related activities) at Maydena Bike Park, or my use or presence in Maydena Bike Park, due to any cause whatsoever, including but not limited to; negligence, breach of contract, or breach of any statutory or any other duty of care. I understand that negligence includes failure on the part of the releasees to take reasonable steps to safeguard and protect me from the risks, dangers, and hazards of using these facilities.
